What is Modifier AK?
Modifier AK identifies a service furnished by a nonparticipating physician under specific Medicare billing circumstances.
A nonparticipating physician is a physician who has not entered into a Medicare participation agreement to accept assignment on all Medicare claims. This is different from a practitioner who has formally opted out of Medicare.
Modifier AK provides additional claim information about the physician's participation status when required under applicable Medicare payment rules.
The modifier does not describe the medical service itself. The CPT or HCPCS code identifies the service performed, while AK communicates applicable information about the physician furnishing it.
When to Use Modifier AK

When NOT to Use Modifier AK

Opted-Out Physician: Medicare opt-out status is different from nonparticipating status. AK should not be used merely because a physician has opted out of Medicare.
Nonphysician Practitioner: Do not automatically use AK for services furnished by another practitioner type.
Modifier Is Not Required: AK should not be routinely appended to every claim from a nonparticipating physician when the applicable billing rules do not require it.
To Change Assignment Status: Modifier AK should not be used as a substitute for correctly completing Medicare assignment and claim information.

A physician with Medicare nonparticipating status furnishes an eligible covered professional service to a Medicare beneficiary.

An opted-out physician has formally opted out of Medicare and generally enters into private contracts with Medicare beneficiaries for applicable services.
Modifier AK should therefore not be interpreted as an indication that a physician has opted out of Medicare.
